# Terms of Service and Participant Agreement
**Last updated: 23 September 2026**
These Terms of Service and Participant Agreement apply to bookings made with and services provided by **Messy Kingdom Limited**, trading as **Messy Kingdom** (“Messy Kingdom”, “we”, “us” or “our”).
By completing a booking, you confirm that you have read and agree to these Terms, our Returns, Refunds, Cancellations and Transfers Policy, and our Privacy Policy.
## 1. Who may make a booking
The person completing the booking must:
- Be at least 18 years old
- Be the child’s parent, legal guardian or an adult caregiver authorised to make the booking
- Have authority to accept these Terms for every participating child or young person included in the booking
- Provide accurate contact, booking and payment information
## 2. Messy Kingdom sessions
Messy Kingdom provides child-focused messy and sensory play experiences for children and young people of different ages, stages and abilities.
Some sessions may be designed with babies and younger children in mind, while others may be suitable for older children or mixed age groups. Each session listing may include a recommended age range based on the planned activities.
Age recommendations are generally a guide rather than an automatic exclusion, unless a particular age restriction is required for safety.
Older children, disabled children and children with additional sensory, developmental or support needs are welcome where the session and activities are suitable for them.
Parents and caregivers are responsible for deciding whether a session is appropriate for the individual child in their care. You are welcome to contact us before booking if you would like more information about the planned activities.
Non-participating siblings and accompanying adults do not require a ticket unless otherwise stated.
Activities vary between sessions and may include:
- Water play
- Foam and bubbles
- Paint and craft materials
- Food-based sensory materials
- Dyed rice, pasta, dough or grains
- Scooping, pouring and digging activities
- Small play pieces, tools and themed equipment
- Wet, slippery, sticky or staining materials
- Messy and non-messy play stations
Activities shown in advertising are examples. Exact activities, colours, ingredients and equipment may change because of availability, allergies, weather, venue restrictions or safety considerations.
## 3. Parent and caregiver supervision
Messy Kingdom sessions are not a childcare service.
A responsible adult must:
- Remain at the venue throughout the session
- Directly and actively supervise every child or young person in their care
- Ensure activities and equipment are used appropriately
- Prevent children from eating sensory materials or placing unsafe items in their mouths
- Follow all reasonable safety instructions given by Messy Kingdom staff
- Step in or remove a child from an activity when necessary
- Take responsibility for toileting, feeding, medication and personal care
- Ensure the child does not harm other participants, staff, equipment or the venue
Messy Kingdom staff provide and facilitate the activities but do not take over the parent or caregiver’s supervisory responsibility.
## 4. Participant safety acknowledgement
Messy and sensory play involves ordinary risks that cannot be removed completely.
These may include:
- Slips, trips and falls
- Contact with wet or slippery surfaces
- Minor bumps, scratches or skin irritation
- Contact with paint, foam, water, grains, food-based ingredients and other sensory materials
- Allergic reactions or sensitivities
- Choking risks from small or loose items
- Clothing, footwear or personal belongings becoming wet, messy, stained or damaged
By completing a booking, you acknowledge these risks and voluntarily choose to allow the participating child or children in your care to take part.
You agree to supervise them closely, follow safety instructions and stop their participation in any activity you consider unsuitable.
This acknowledgement does not exclude or limit Messy Kingdom Limited’s legal health and safety responsibilities or any rights that cannot lawfully be excluded.
## 5. Taste-safe and food-based materials
Some activities may be described as “taste-safe” or may use food-based ingredients.
Taste-safe means commonly used food-grade ingredients have been selected to reduce the risk if a small amount is accidentally tasted.
It does not mean that:
- The activity is intended to be eaten
- The sensory material is suitable as food
- The activity is allergen-free
- The material is safe for every child
- Adult supervision is unnecessary
Children must be actively supervised and discouraged from eating sensory materials.
## 6. Allergies and medical considerations
Messy Kingdom may use products or ingredients containing or exposed to common allergens, including wheat, gluten, dairy, eggs, soy, food colouring and other food-based ingredients.
Although we take reasonable care, we cannot guarantee that activities, tools, surfaces or venues are completely free from allergens or cross-contamination.
Parents and caregivers are responsible for:
- Assessing whether an activity is suitable for their child
- Checking available ingredient information
- Informing Messy Kingdom of serious allergies or relevant safety requirements before participating
- Preventing their child from using an unsuitable activity
- Carrying any medication or emergency treatment their child may require
- Administering any medication their child needs
Providing allergy or medical information does not transfer supervision or medical responsibility to Messy Kingdom.
Please contact us before booking if you need information about whether a session can reasonably accommodate a particular requirement.
## 7. Illness
Please do not attend if a participating child or accompanying adult:
- Is unwell or contagious
- Has vomiting, diarrhoea, a fever or another infectious illness
- Has symptoms that may put other families at risk
- Has been advised to isolate or avoid group activities
Illness-related transfer requests are handled under our Returns, Refunds, Cancellations and Transfers Policy.
## 8. Clothing and personal belongings
Please dress children and accompanying adults in clothing and footwear that can become wet, messy or stained.
We recommend bringing suitable spare clothing and a towel where appropriate.
Messy Kingdom is not responsible for ordinary staining, mess or damage caused by participating in messy play, except where responsibility cannot legally be excluded.
You remain responsible for personal belongings brought to the venue. Please do not bring valuable or fragile items into the activity area.
## 9. Behaviour and removal from a session
Messy Kingdom aims to provide a safe, welcoming and inclusive environment.
We may ask a participant or accompanying person to stop an activity or leave the session if their behaviour:
- Creates an unreasonable safety risk
- Is aggressive, abusive, threatening or seriously disruptive
- Causes deliberate damage
- Repeatedly ignores reasonable safety instructions
- Prevents other families from safely enjoying the session
We will take the individual needs of children and young people into account wherever reasonably possible.
A refund will not normally be provided where removal results from unsafe, abusive or seriously inappropriate behaviour.
## 10. Bookings and payments
All advertised prices are in New Zealand dollars unless stated otherwise.
A booking is confirmed only when payment has been successfully completed and a booking confirmation has been issued.
You are responsible for checking:
- The session date and time
- The venue and location
- The session theme
- Any recommended age or suitability information
- The ticket type and quantity
- The information entered during checkout
Bookings are subject to availability.
We may correct genuine pricing, scheduling or listing errors. If an error materially affects a confirmed booking, we will contact you and provide an appropriate option, which may include correcting the booking, transferring it or issuing a refund.
## 11. Cancellations, transfers and refunds
Cancellations, transfers, illness-related make-up sessions, no-shows and refunds are governed by our Returns, Refunds, Cancellations and Transfers Policy.
That policy forms part of these Terms.
## 12. Arrival and session times
You may arrive at any time during the advertised session unless otherwise stated.
Sessions finish at the advertised time. Arriving late does not extend the session or create an entitlement to a refund.
Parents and caregivers must follow reasonable venue instructions, including rules relating to parking, restricted areas, emergency exits and facilities.
## 13. Photography and video
Photography and video permission is separate from accepting these Terms.
Photos and videos may be taken during Messy Kingdom sessions, private bookings, events and other activities for use on our website, social media, advertising and promotional materials.
When booking, parents and caregivers may select one of the following options:
**Full consent**
The child may be photographed or filmed, including their face, and the content may be used by Messy Kingdom for website, social media, advertising and promotional purposes.
**Limited consent**
The child may appear only where their face is not clearly visible or identifiable. This may include photos of hands participating in activities, photographs from behind, close-up activity shots or wider play images.
**No consent**
The child will not be intentionally photographed or filmed.
Messy Kingdom may use an identification system, such as coloured wristbands, to help staff recognise participants with limited or no photography consent.
Refusing photography permission will not prevent you from making a booking or participating.
You may speak to Messy Kingdom staff before or during a session if you want to confirm or change your photography preference.
Participants and accompanying adults must not intentionally take or publish identifiable photographs or videos of other children without permission from their parent or caregiver.
## 14. Accessibility and inclusion
Messy Kingdom aims to provide welcoming and inclusive play opportunities for children and young people of different ages and abilities.
Disabled children, neurodivergent children and children with additional sensory, developmental, physical, learning or support needs are welcome, including children who may be older than the recommended age shown for a session.
You do not need to disclose a diagnosis.
However, parents and caregivers may contact us before booking to share any information that could help us support their child’s safety, comfort or participation.
Where practical, we will discuss reasonable adjustments that may help a child participate.
However:
- Not every venue or activity will be suitable for every individual need
- Messy Kingdom cannot provide one-to-one care or supervision
- A responsible caregiver must remain with and actively supervise the child
- Caregivers remain responsible for deciding whether each activity is appropriate for their child
Children may participate at their own pace and are not required to use every activity provided.
## 15. Website use
You must not misuse our website, interfere with its operation, attempt unauthorised access, submit false information or use the website for unlawful or fraudulent purposes.
We aim to keep website and session information accurate, but occasional errors or interruptions may occur.
Links to third-party websites or services are provided for convenience. Messy Kingdom does not control those services and is not responsible for their content, availability or privacy practices.
## 16. Intellectual property
Messy Kingdom’s name, logo, website content, activity descriptions, graphics and original promotional materials must not be copied, reproduced or commercially used without permission.
Sharing links to our publicly available website or social media content is permitted.
## 17. Liability and consumer rights
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other right that cannot lawfully be excluded.
To the maximum extent permitted by law, Messy Kingdom Limited is not responsible for loss or damage resulting from:
- A parent or caregiver failing to supervise a child
- A participant ignoring safety instructions
- An allergy or medical condition that was not disclosed or appropriately managed
- Normal mess, staining or wear associated with messy play
- Personal belongings being lost, left behind or damaged
- Circumstances outside our reasonable control
## 18. Privacy
Personal information is handled in accordance with our Privacy Policy.
By completing a booking, you acknowledge that booking and contact information will be processed through Shopify and relevant payment and communication providers.
## 19. Changes to these Terms
We may update these Terms to reflect changes to our sessions, website, providers or legal obligations.
The version applying to your booking will generally be the version published when the booking was made, unless a change is required by law or is reasonably necessary for participant safety.
## 20. Governing law
These Terms are governed by New Zealand law.
